TERMS & CONDITIONS
These contest rules apply to the “Captain Cash” radio contest.
- THE PROMOTER:
“Captain Cash” is a Capital Radio Network wide contest, conducted on radio stations, 2CA Canberra, Eagle FM Goulburn, Snow FM Jindabyne, 3GG Warragul and 6iX Perth, collectively operating as the promoter.
- WHO MAY ENTER:
All entrants must be 18 years or older and reside in NSW, ACT, VIC or WA.
– You are ineligible to enter a competition if:
- you are an employee of, or contractors to, the Promoter or any of its agencies involved with this competition; or
- you are the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household).
- you have won a prize/prizes valued either individually or collectively at more than $100 from the Promoter or in any contest run by the Promoter in the prior 30 days.
- you have been discovered to have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name.
- you have won a prize valued at $1,000 or more from the Promoter or in any contest run by the Promoter in the prior 90 days.
- you have won a prize valued at $5,000 or more from the Promoter or in any contest run by the Promoter in the prior 12 months.
- you are an employee of any broadcast station within NSW, ACT, VIC or WA.
- you have been an employee of the Promoter within the last 60 days.
All contestants acknowledge that the Promoter can rely on Clause 2 and even if the Promoter only learns of a person’s ineligibility after the Promoter has appeared to award the prize to the ineligible person. Return of the prize or payment of its value to the Promoter can be required by the Promoter if this occurs.
- METHOD OF ENTRY
Captain Cash is a game of skill. The promoter will announce the title and artist of each day’s “winning song” and the starting cash prize amount at or around 0715 each morning Monday to Friday (excluding public holidays). The winning song will be broadcast at some time during the day between 0715 and 2359. From time to time throughout each day and until the winning song is broadcast, the promoter will announce an escalating jackpot amount for the day. When the winning song is broadcast, contestants can enter the draw by sending their name by text sms message to 0428 811455. All sms entries must be received during the broadcast of the winning song.
One contestant will be randomly selected from sms entries and telephoned. The contestant must answer the phone within “five rings” and answer with the statement, “Give me the Cash”. If these entry conditions are met then the successful contestant will win the cash jackpot equal to the last announced jackpot amount prior to the winning song being broadcast. If there is no qualifying winner, the contest ends for the day and a new jackpot starting amount will be announced the following day.
- NATURE, VALUE and DISTRIBUTION OF PRIZES:
- The value of each day’s winning cash jackpot will vary each day.
- Cash prize amounts will be direct deposited into a bank account nominated by the winner.
- The promoter accepts no responsibility should the winner provide incorrect bank account details.
- Should a winner fail to provide a bank account number within 14 days of the prize being awarded, the winner will forfeit the prize.
- Any forfeited prizes become null and void.
- Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.
- prizes are non-transferable
- the Promoter and its employees and agents will be fully released from and indemnified by winner in respect of any claim for accident, injury, property damage or loss of life in connection with winner’s participation in the contest.
- PRIZE COLLECTION:
- The promoter may request at its sole discretion a winner to present in person to validate their identity by providing ID which includes a photograph.
- Upon request by the Promoter a copy of the general contest rules and/or a signed receipt and acknowledgement must be signed and endorsed by any winner to indicate his/her understanding and acceptance of these terms.
- Prizes will only be awarded following winner validation and verification to the satisfaction of the promoter.
- The judges’ decision is final, and no correspondence will be entered into.
- PUBLICITY:
Acceptance of a prize constitutes permission for the Promoter to use winner’s name, suburb of residence, recording of winner’s voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
- EXCLUSION OF LIABILITY:
The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery details provided by an entrant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner(s) and, where applicable, to any persons accompanying the winners.
- OWNERSHIP OF ENTRIES:
- all entries (whether in written, audio or visual form, or a combination of those) become and remain the property of the Promoter (subject to the limits contained in the Privacy Statement).
- all winners’ names and contact details will be kept on record, including the prize value awarded to that person.
- DISQUALIFICATION:
- the Promoter is not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
- the Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alternation of entries. Subject to any written directions given under the applicable law, if for any reason, the competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, or proper conduct of the competition, then the –Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition. The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
- tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
- tampering with the operation of the competition or web site;
- acting in violation of these terms and conditions;
- acting in an unsportsmanlike or disruptive manner; or
- if an entrant selected as winner is found to be in breach of paragraphs 3 or 4 of these conditions of entry, a new winner may be selected and, in the event that the entrant in breach has been awarded a prize, the entrant may be required to return the prize or reimburse the value of the prize to the Promoter.
- PARTICIPATION:
Participation in the competition constitutes the entrant’s unconditional agreement to and acceptance of these General Competition Entry Rules. These rules may change from time to time. The Entrant is responsible for insuring his or her familiarity with the General Competition Entry Rules at the time of participation. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the General Competition Entry Rules generally.
- DURATION OF THE PROMOTION
Captain Cash will commence on Monday 9th September 2024 and conclude at 6pm on Friday 20th September 2024. All winners will be notified by telephone and announced on-air at the time of the prize draw.

These standard contest rules apply to all the Promoter’s contests. They may be amended or varied from time to time by the station. Special rules may apply to particular contests, in which case an addendum to these rules will be made for that Contest. Please inquire at the station for any special rules for contests you wish to enter.

2. WHO MAY ENTER:

ix) you have been an employee of the Promoter within the last 60 days.

3. METHOD OF ENTRY
– entry to individual contests can be either or all of the following: phone/coupon/fax/email/post. The correct method will be advised either on-air or in writing for individual competitions.
– all competitions will be promoted on either or all of the following mediums: radio/tv/print/internet/instore
4. NATURE & VALUE OF PRIZES:
– various prizes on offer may include items such as CDs/videos/DVDs/movie tickets/cash/dinners/concert tickets/goods/services, none of which exceed an individual value of $1000.
– the total value of prizes awarded under this Blanket Permit will not exceed $50,000.
– all prizes must be collected within 6 weeks from the date of winning. In the event a winner choosing not to collect their prize within that period forfeits any and all claims to such a prize – an alternate will not be offered.
– all prize items are valued inclusive of GST and the Promoter takes no responsibility for any variation in item values. Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.
– prizes are non-transferable and may not be redeemed for cash. If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of like or equal value. – – Unless otherwise specified, the class of travel for and travel prize incorporating an airfare is economy class.
– any tax payable as a result of a prize being awarded or received will be the winner’s responsibility.
– in relation to prizes involving participation in any activity –
a) the Promoter and its employees and agents will be fully released from and indemnified by winner in respect of any claim for accident, injury, property damage or loss of life in connection with winner’s participation in the prize.
b) winner may, at the option of station as precondition to entitlement to prize, and
c) if a winner is under the age of 18, their parent/guardian will need to sign the indemnity and consent to winner’s participation in prize.

– Prizes must be claimed in person unless winner is otherwise advised. ID which includes a photograph, will be required. The collection of prizes is the sole responsibility of the winner.

– By entering a competition, the entrant acknowledges and accepts that their contact details may be provided to a third party for promotional purposes.

– The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery details provided by an entrant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner(s) and, where applicable, to any persons accompanying the winners.
– A winner (or his or her guests/parent/guardian as appropriate) may be required to sign and return any liability release provided by the Promoter and/or its contractors as a condition of the prize being awarded. – Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and a selection of another winner.
8. OWNERSHIP OF ENTRIES:
– all entries (whether in written, audio or visual form, or a combination of those) become and remain the property of the Promoter (subject to the limits contained in the Privacy Statement).
– all winners names and contact details will be kept on record, including the prize value awarded to that person to ensure conditions of the Blanket Permit are met.

-Where the Promoter has special contest conditions or rules in relation to a particular contest, then they will prevail to the extent of any inconsistency between those special conditions and these General Competition Entry Rules.
11. METHOD OF ADVISING RESULTS OF DRAW
The prize winner will be announced at the time of the draw live on-air.
All winners will be notified in writing within 7 days of winning their prize.
Forever Classic 6iX – SOCIAL MEDIA COMPETITIONS
TERMS & CONDITIONS – These terms & conditions apply to our regular ‘Social Media Giveaways’
Social Media Entry. If a Promotion is conducted or involves entry via a social media platform, the following will apply.
1. For the purposes of these Terms and Conditions, The Promoter refers to Radio Perth Pty Ltd, Level 1, 46 King Edward Road, Osborne Park, WA 6017 (A.C.N. 085 146 809). Our Facebook handle 6iX Perth & Instagram handle is @6ix_perth.
2.By entering the competition you agree to be bound by these terms and conditions.
3.All entries must be received by closing time stated in the caption of the post. Winner(s) will be selected at random by The Promoter and the winner will be notified on or after this date.
4.The Promotors competitions with entry via Instagram and/or Facebook are open only to residents of Western Australia, winner will be chosen at random from all entrants and across all platforms.
5. An entrant’s entry must be submitted by the individual entrant; entrants must ensure their security settings on their personal account allows the Promoter to contact them in the event that the entrant is a winner.
6.Use of social media platforms is subject to the terms and conditions of use of that social media platform;
7.Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform. The winner and their companion(s) (if any) are solely responsible and liable for the content of their entries and/or posts and any other information they transmit to other Internet users; andto the extent permitted by law, the winner and their companions agree to release any and all social media platforms (and their associated agencies and companies) used in conjunction with the Promotion, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by the winner and their companions in respect of their participation in the Promotion.
8.No purchase necessary. Winners will not be required to pay to enter the competition. Never supply payment details to 6iX or anyone claiming to be 6iX via private message.
9.Entrants must be over 18 years old on the date of their entry.
10.Employees of The Promoter are not eligible to enter.
11.Only one entry per person per competition will be accepted.

13.The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled.
14.The Promoter will not be liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, hidden through privacy settings, illegible, corrupted, damaged, incomplete or otherwise invalid.
15.To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
16.To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
17.Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.
18.The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfilment of the Prize.
19.In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
20.The Promoter’s decision is final. No correspondence will be entered into.
21.The winner’s name and social media username may be posted on the social media profiles of The Promotor after the winner has been selected.
